Terms of Service

Application: BespokeOSPro — the internal staff operations platform of Blueburry Royale Inc. (DBA BR Bespoke), accessible at https://bespokeospro.web.app.

These Terms of Service ("Terms") govern your access to and use of the BespokeOSPro application, services, websites, retail studios, and bespoke garment production offered by Blueburry Royale Inc., a California corporation, doing business as BR Bespoke ("BR Bespoke," "we," "us," or "our"). By placing an order, booking a fitting, signing into BespokeOSPro, or otherwise engaging with our services, you agree to be bound by these Terms.

1. Bespoke Production

Every BR Bespoke garment is custom-made to your individual measurements, fabric selection, and style specifications in our offshore production workshops. Each piece is produced specifically for you and is not held in stock or resaleable to another customer.

2. Orders, Pricing, and Payment

All prices are quoted in United States Dollars unless explicitly stated otherwise. Payment terms are presented to you at the time of order placement, including any required deposit and the schedule for the remaining balance. Full payment must be received before delivery. Payments are processed securely through Authorize.net; we do not store full card numbers on our systems.

3. No Cancellations or Refunds

Because each order is produced specifically for you using your measurements and chosen fabric, orders cannot be cancelled and payments are non-refundable once production has begun. By placing an order and accepting the order-specific Terms presented at payment, you acknowledge and accept this policy.

4. Remakes

If a garment does not meet our quality standards or your agreed specifications, BR Bespoke will, at its sole discretion, offer a remake, a discount, or another resolution. Remake decisions are made on a case-by-case basis after review of the relevant photos, measurements, and order details. Fault determination follows our internal protocols and may result in cost being borne by the workshop, the fabric supplier, the style consultant, or BR Bespoke as appropriate.

5. Measurements and Fittings

You are responsible for the accuracy of your measurements when measurements are self-supplied. Where measurements are taken by a BR Bespoke style consultant, we maintain those records for the purpose of fulfilling your current and future orders. Fitting appointments must be honored or rescheduled in advance per our appointments policy.

6. Intellectual Property

All content, designs, photographs, branding, and software made available by BR Bespoke (including the BespokeOSPro internal application) are owned by Blueburry Royale Inc. or its licensors. No part may be copied, reproduced, or used commercially without our prior written consent. You retain ownership of any personal information you provide to us, subject to the rights granted in our Privacy Policy.

7. Account and Access

If you are a staff member, vendor, or workshop using our internal BespokeOSPro application, you agree to use your credentials only for authorized business purposes, to safeguard your access, and to comply with the role-based access boundaries set by BR Bespoke. We reserve the right to suspend or revoke access at any time without notice.

8. Third-Party Services

We use trusted third-party services to operate our business, including Google (Calendar / Authentication), Firebase (Google Cloud Platform), Authorize.net (payments), Brevo (email), and Hostinger (website hosting). Your use of our services may be subject to those providers' own terms.

9. Disclaimer of Warranties

To the maximum extent permitted by law, our services are provided "as is" without warranties of any kind, except for those that cannot be excluded under California law. We do not warrant uninterrupted access to our website or applications.

10. Limitation of Liability

To the maximum extent permitted by law, BR Bespoke's total aggregate liability for any claim arising from or relating to these Terms or your use of our services shall not exceed the total amount you paid to BR Bespoke for the specific order giving rise to the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, USA, without regard to its conflict of laws principles. Any dispute arising from these Terms shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction in those courts.

12. Changes to These Terms

We may update these Terms from time to time. The updated version takes effect when posted at this URL with a new effective date. Continued use of our services after an update constitutes acceptance of the revised Terms.
